I. OPENING STATEMENT
Your Honor,
My name is Otis Spuckler, and I appear before this Court as both the Plaintiff and self representing litigant in this civil action against Greston Diddy, Reston Diddy, Hermann Emerson, and the San Andreas Police Department, henceforth known as the Defendants. The "SAPD" abbreviation stands for "San Andreas Police Department" in this litigation.
On the 27th of July, 2025, at approximately 00:11 CET, I, Otis Spuckler, was the victim of an aggravated attempted murder, carried out with complete disregard for human life. The individuals responsible for this offense are Police Officer Greston Diddy, Reston Diddy, and Cadet Hermann Emerson, who ordered the assault.
Following the incident, I was revived by Captain James Campbell, to whom I immediately requested a supervisor to handle this matter and initiate an internal investigation into this unlawful use of excessive force and attempted murder. Instead of pursuing justice by dishonorably discharging them from the police force and holding them detained for prosecution, the department responded by offering me $400,000 USD and issuing a mere 3 day suspension to the involved officers, namely, Greston Diddy, Reston Diddy, and Hermann Emerson. Your Honor, I pose this question to the Court, what kind of law enforcement agency offers financial compensation and then verbally claims to issue a minor disciplinary action in response to an attempted murder and excessive use of force on a harmless and defenseless civilian's life, unless it tacitly acknowledges wrongdoing? If I had died that night, would this case have been swept under the rug with a payout or a slap on the wrist? Or perhaps bother to internally investigate this case?
This Court must recognize the gravity of these criminal offenses by this department and its employees, where two or three police officers deliberately discharged their firearms at me with the intent to injure or possibly kill, as they nearly did. Their actions breach the very "Department Manual" they are taught to uphold. I quote now from the SAPD Manual of Procedure, [INFO] Department Manual, which they so clearly violated:
"010.20 ACCOUNTABILITY, 010.21 RESPONSIBILITY FOR ACTIONS
An officer is always accountable for their actions and decisions in performing their daily duties. Misuse of authority or conduct unbecoming of an officer is subject to review and may result in a minimum punishment of suspension."
This provision clearly states that orders do not excuse misconduct. Every officer is responsible for their actions, so this gross misconduct and crime cannot be condoned because of an order that was given to them.
"020.50 SHOOTING AT OR FROM VEHICLES
It is the policy of this department that officers shall not discharge a firearm at a moving vehicle, unless such force is necessary for one of the following reasons: number 1. Occupants are actively discharging a firearm at a person or an officer, or, number 2. Occupants have previously discharged a firearm at an officer and are fleeing. If an officer was run over, officers on foot may discharge a firearm at the moving vehicle only at the place of occurrence."
Your Honor, none of these justifications were present, I was driving slowly, I did not brandish any weapon in or out of my vehicle, and I did not attempt to harm anyone. The dashcam footage of Police Rancher and Police Infernus, and the bodycam of Greston Diddy, Reston Diddy, and Hermann Emerson can confirm the fact that they partially opened fire at me while they were seated in a moving vehicle.
"020.30 DEADLY FORCE
It is the policy of this department that officers shall use lethal equipment upon another person only when the officer reasonably believes, based on the totality of circumstances, that such force is necessary for one of the following reasons: number 1. Defend against an imminent threat of death or serious bodily injury to oneself or another person, or, number 2. Apprehend a fleeing person for any felony that resulted in death or serious bodily injury to oneself or another officer."
What part of this manual code qualifies a justification to use lethal force against me and the vehicle I was driving? I was merely driving down the public road without harming anyone, this can be fact checked by their own police dashcam and bodycam.
The quotation phase is over. I possess no other evidence beyond my medical history and documentation in relation to this matter, the direct admission of misconduct or transgression committed by the involved officers through the inadequate compensation presented by the command office of the San Andreas Police Department, and my own wounded and surgically undergone body, which was riddled with bullets. However, the San Andreas Police Department possesses the most crucial pieces of digital and physical evidence, which include the police radio transmission logs or recorded audios, police dashcam footage, and bodycam footage from the scene of the incident to the subsequent investigation of the complaint and conclusion of the complaint that was mishandled by Captain James Campbell and Chief of Police Kacper Kowalski. These can be judicially inquired into and obtained in the form of a subpoena and promptly reviewed by this Court to confirm my claims that have occurred in this incident. As of this date, the San Andreas Police Department has not logged any punitive or disciplinary action against the aforementioned officers, according to their website thread, check [INFO] Discharges, Punishments. The Court should take note that the newly issued punishment to Greston Diddy is a separate case that was reported by me and is irrelevant to the current case, although it does partially support one of the aspects of this case, the use of excessive force, according to Greston Diddy's departmental record which was logged on the 28th of July, 2025. This alone must prove how ineligible Greston Diddy is to be serving as a police officer in our community.
Let me present another statement regarding the San Andreas Police Department's admission of guilt. Evidently, the SAPD has offered inappropriate compensation to me as a result of this incident. This is clear proof of their departmental acknowledgement of their guilt, but audaciously, they have condoned the criminal actions of their own officers. Your Honor, they have failed to "enforce the law" in this situation, this is the ultimate definition of "Bias".
Your Honor, I request that this Court hold the involved officers and the San Andreas Police Department that condoned their police officers' actions, fully liable under the law. I now move to formally address the violated state laws and federal laws, although I am not a state prosecutor or a federal prosecutor, but I am a citizen with a right to have a fair trial, and I firmly believe the following state law and federal law violations have occurred by the mentioned Police Officers and the San Andreas Police Department, hence, I respectfully ask this Court and the next prosecutorial authority to take the following argument into account for future references.

Pre-operative Diagnosis:
Primary: Multiple Gunshot Wounds (GSWs) to the upper torso — including the left back, flank, and scapular regions (25 total entry wounds).
Secondary: Suspected intercostal artery injury and pulmonary contusion with signs of internal hemorrhage and respiratory compromise.
Post-operative Diagnosis:
Primary: Multiple Gunshot Wounds to upper torso (left back, flank, scapula) confirmed.
Secondary: Right intercostal artery injury (actively bleeding) successfully ligated; pulmonary contusion managed conservatively.
Clinical Findings:
Upon arrival, the patient presented with multiple penetrating wounds to the left upper back, scapular region, and lateral thoracic wall, consistent with high-velocity gunshot injuries. There was active external bleeding and signs of hypovolemic shock (tachycardia, hypotension, altered mental status).
Breath sounds were decreased on the left side. Palpation indicated subcutaneous emphysema and tenderness over the ribs and scapula.
Initial chest X-ray and CT confirmed:
=Multiple metallic foreign bodies (bullet fragments) in the thoracic cavity
=Left-sided hemothorax
=Pulmonary contusion in the lower lobe
=Disruption of intercostal vasculature, consistent with active internal bleeding
No spinal injury or major vascular trauma was identified. Neurological status remained intact.
Operation Performed:
Exploratory Thoracotomy with Removal of Multiple Projectiles, Hemostasis of Intercostal Artery, and Management of Pulmonary Contusion
Procedure:
After informed consent was obtained and general anesthesia was administered, the patient was placed in a left lateral decubitus position. A left-sided exploratory thoracotomy was initiated through the 5th intercostal space. Upon entry into the thoracic cavity, active hemorrhage from a lacerated intercostal artery was identified. Immediate hemostasis was achieved using ligation and electrocautery.
A systematic exploration of the thoracic cavity and surrounding musculature revealed twenty-five (25) retained bullet fragments localized in the left upper back, scapular region, and lateral thoracic wall. These were carefully dissected and removed individually. Surrounding tissues were assessed for necrosis or vascular compromise.
Inspection of the pulmonary parenchyma indicated a moderate pulmonary contusion on the left lower lobe, presenting as a bruised, edematous, and congested area without active bleeding or major laceration. Contused lung segments were managed conservatively; no lobectomy was required.
The thoracic cavity was irrigated with warm saline, and two chest tubes were placed for drainage and post-operative lung re-expansion. The incision was closed in anatomical layers with absorbable sutures.
The removed projectiles were carefully catalogued and secured in a sealed evidence bag, then handed over to Mr. Otis Spuckler. Container ID #0002, chain of custody: Dr. Natasha Myers

Your Honor, the officers who nearly ended my life walk free, the police department harbors murderous officers, but my body carries the trauma, my life was nearly taken, and I'm unable to physically or mentally perform the duties required by my profession, this unfortunate incident has led to a complete loss of income and professional stability, causing financial and emotional hardship, and my only recompense was hush money. This is not justice, this is a systemic failure, and I ask this Court to bring justice upon it. Therefore, I respectfully demand the following:
- 1. The Defendants (Greston Diddy and Reston Diddy) to be dishonorably discharged from the San Andreas Police Department.
- 2. A formal request for the Court to issue arrest warrants and task the Internal Affairs Bureau of the San Andreas Police Department or the Federal Bureau of Investigation with its execution to promptly apprehend and prosecute the Defendants (Greston Diddy and Reston Diddy) for imprisonment in the state penitentiary in accordance with the state law and federal laws.
- 3. A subpoena to be issued to compel the release of police vehicle (Infernus) and (Police Rancher) dashcam footage and bodycam footage of Greston Diddy, Reston Diddy, Hermann Emerson, James Campbell, Kacper Kowalski, and the police radio tranmission in the format of MP3 audio or encrypted transcript from the San Andreas Police Department database. The mentioned dates and times are required to further prove my claims (Time: From 00:11 CET to 01:04 CET, Date: 27/07/2025) | (Time: From 23:03 CET to 23:50 CET, Date: 27/07/2025).
Off Topic(( OOC: I have all the chatlog and a few screenshots to prove my claims, I will accordingly submit them once the Court gains access to those footages, and of course, more explanations will be provided for each footage as two different timelines were mentioned above. ))
- 4. A federal investigation to be launched into this matter, with top priority and urgency. The investigation should focus not only on the initial incident, which is attempted murder, but also on the systemic failure to address it, and whether departmental corruption is present within the San Andreas Police Department's leadership.
- 5. Upon the adjudication of this case, the San Andreas Police Department must issue a formal public apology to Mr. Otis Spuckler. This apology must be published across the department's official social media platforms and accompanied by a written letter of apology bearing the official San Andreas Police Department seal and the signature of Chief of Police Kacper Kowalski, acknowledging the wrongdoing, preserving public accountability, and restoring the dignity of the victim.
- 6. A total compensation of surgical expenses, mental and physical therapeutic expenses, medication and prognosis expenses, financial loss due to physical and mental inability to perform my duties in my profession, and $2,000,000 USD for the remedy of being a victim of heinous police criminality and brutality.
- 7. A formal Court recommendation for a full reevaluation of Chief of Police Kacper Kowalski and Captain James Campbell's eligibility to continue serving in command positions within the San Andreas Police Department.
- 8. Referral to the state prosecutors and federal prosecutors for potential criminal prosecution under federal and state law as addressed in the I. OPENING STATEMENT.
- 9. Request the Court to summon and form an ad hoc committee from the U.S. House of Representatives to review the conduct of San Andreas Police Department personnel involved in this matter, especially the command chain.
- 10. Request for immediate suspension of the following officers (Greston Diddy, Reston Diddy, Hermann Emerson) while this civil action is pending review and adjudication.
- 11. Request for immediate suspension of Chief of Police Kacper Kowalski from the Staff Office and Captain James Campbell from the Command Office while this civil action is pending review and adjudication, if deemed necessary and justified by the Court.
IV. SETTLEMENT OFFER
The Plaintiff provides no settlement offer at the moment.
