I. OPENING STATEMENT
Your Honor,
The Bureau formally brings charges against the defendant, Cadet Greston Diddy, for his direct involvement in an incident that took place on July 27th, 2025, at approximately 00:11 CET in Red County, specifically in the vicinity east of Hilltop Farm.
On the specified date and time, a civilian, Mr. Otis Spuckler, was operating his vehicle, a yellow Rancher, near the scene of an unrelated law enforcement operation. While Mr. Spuckler was within visual proximity of this active scene, he was instructed to leave the area by the defendant, Cadet Emerson.
However, as Mr. Spuckler complied and began exiting the area, Cadet Emerson issued an instruction over the police radio to open fire on the "yellow Rancher", which was at that time posing no immediate threat to any officer or the ongoing operation. Acting on this directive, Cadet Emerson, along with Cadet Reston Diddy and Cadet Greston Diddy, discharged their firearms at the civilian vehicle, striking Mr. Spuckler multiple times.
This use of force was unlawful, unprovoked, and presented gross disregard for life of Mr. Spuckler who was unarmed. The decision to engage was not only a violation of protocol and use-of-force policy, but also demonstrated an alarming lack of judgment, training, and command structure discipline. It is particularly concerning that a Cadet, who is by definition still under training, was able to issue such a directive, and worse, that it was followed without question by others present on the scene.
As a result of this reckless action, Mr. Otis Spuckler sustained multiple gunshot wounds, requiring urgent medical attention and ongoing treatment. His life was endangered without cause, and the trauma inflicted upon him is both physical and psychological.
II. CHARGES
[1x] U.S. CODE TITLE V, (2) Any person in a position of power, whether a law enforcement official, emergency service official, government official or a judicial official, who maliciously uses power shall be removed from the position and imprisoned for no less than 1 year and no more than 20 years;
1x] U.S. CODE TITLE VI, (4) Any person which unlawfully kills or attempts to unlawfully kill another person, unless through self defense which occurred on the premises of the killer's home and is provable through investigative means, shall be imprisoned for no less than 10 and no more than a life sentence;
[1x] U.S. CODE TITLE VI, (F) Accomplice
(1) Any person who knowingly, voluntarily, or intentionally gives assistance to another in (or in some cases fails to prevent another from) the commission of a crime. An accomplice shall receive the same prison sentence or a monetary fine as the principal.
