I. OPENING STATEMENT

Your Honor,

My name is Otis Spuckler, and I appear before this Court as both the Plaintiff and self representing litigant in this civil action against Greston Diddy, Reston Diddy, Hermann Emerson, and the San Andreas Police Department, henceforth known as the Defendants. The "SAPD" abbreviation stands for "San Andreas Police Department" in this litigation.

On the 27th of July, 2025, at approximately 00:11 CET, I, Otis Spuckler, was the victim of an aggravated attempted murder, carried out with complete disregard for human life. The individuals responsible for this offense are Police Officer Greston Diddy, Reston Diddy, and Cadet Hermann Emerson, who ordered the assault.

Following the incident, I was revived by Captain James Campbell, to whom I immediately requested a supervisor to handle this matter and initiate an internal investigation into this unlawful use of excessive force and attempted murder. Instead of pursuing justice by dishonorably discharging them from the police force and holding them detained for prosecution, the department responded by offering me $400,000 USD and issuing a mere 3 day suspension to the involved officers, namely, Greston Diddy, Reston Diddy, and Hermann Emerson. Your Honor, I pose this question to the Court, what kind of law enforcement agency offers financial compensation and then verbally claims to issue a minor disciplinary action in response to an attempted murder and excessive use of force on a harmless and defenseless civilian's life, unless it tacitly acknowledges wrongdoing? If I had died that night, would this case have been swept under the rug with a payout or a slap on the wrist? Or perhaps bother to internally investigate this case?

This Court must recognize the gravity of these criminal offenses by this department and its employees, where two or three police officers deliberately discharged their firearms at me with the intent to injure or possibly kill, as they nearly did. Their actions breach the very "Department Manual" they are taught to uphold. I quote now from the SAPD Manual of Procedure, [INFO] Department Manual, which they so clearly violated:

"010.20 ACCOUNTABILITY, 010.21 RESPONSIBILITY FOR ACTIONS
An officer is always accountable for their actions and decisions in performing their daily duties. Misuse of authority or conduct unbecoming of an officer is subject to review and may result in a minimum punishment of suspension."


This provision clearly states that orders do not excuse misconduct. Every officer is responsible for their actions, so this gross misconduct and crime cannot be condoned because of an order that was given to them.

"020.50 SHOOTING AT OR FROM VEHICLES
It is the policy of this department that officers shall not discharge a firearm at a moving vehicle, unless such force is necessary for one of the following reasons: number 1. Occupants are actively discharging a firearm at a person or an officer, or, number 2. Occupants have previously discharged a firearm at an officer and are fleeing. If an officer was run over, officers on foot may discharge a firearm at the moving vehicle only at the place of occurrence."


Your Honor, none of these justifications were present, I was driving slowly, I did not brandish any weapon in or out of my vehicle, and I did not attempt to harm anyone. The dashcam footage of Police Rancher and Police Infernus, and the bodycam of Greston Diddy, Reston Diddy, and Hermann Emerson can confirm the fact that they partially opened fire at me while they were seated in a moving vehicle.

"020.30 DEADLY FORCE
It is the policy of this department that officers shall use lethal equipment upon another person only when the officer reasonably believes, based on the totality of circumstances, that such force is necessary for one of the following reasons: number 1. Defend against an imminent threat of death or serious bodily injury to oneself or another person, or, number 2. Apprehend a fleeing person for any felony that resulted in death or serious bodily injury to oneself or another officer."


What part of this manual code qualifies a justification to use lethal force against me and the vehicle I was driving? I was merely driving down the public road without harming anyone, this can be fact checked by their own police dashcam and bodycam.

The quotation phase is over. I possess no other evidence beyond my medical history and documentation in relation to this matter, the direct admission of misconduct or transgression committed by the involved officers through the inadequate compensation presented by the command office of the San Andreas Police Department, and my own wounded and surgically undergone body, which was riddled with bullets. However, the San Andreas Police Department possesses the most crucial pieces of digital and physical evidence, which include the police radio transmission logs or recorded audios, police dashcam footage, and bodycam footage from the scene of the incident to the subsequent investigation of the complaint and conclusion of the complaint that was mishandled by Captain James Campbell and Chief of Police Kacper Kowalski. These can be judicially inquired into and obtained in the form of a subpoena and promptly reviewed by this Court to confirm my claims that have occurred in this incident. As of this date, the San Andreas Police Department has not logged any punitive or disciplinary action against the aforementioned officers, according to their website thread, check [INFO] Discharges, Punishments. The Court should take note that the newly issued punishment to Greston Diddy is a separate case that was reported by me and is irrelevant to the current case, although it does partially support one of the aspects of this case, the use of excessive force, according to Greston Diddy's departmental record which was logged on the 28th of July, 2025. This alone must prove how ineligible Greston Diddy is to be serving as a police officer in our community.

Let me present another statement regarding the San Andreas Police Department's admission of guilt. Evidently, the SAPD has offered inappropriate compensation to me as a result of this incident. This is clear proof of their departmental acknowledgement of their guilt, but audaciously, they have condoned the criminal actions of their own officers. Your Honor, they have failed to "enforce the law" in this situation, this is the ultimate definition of "Bias".

Your Honor, I request that this Court hold the involved officers and the San Andreas Police Department that condoned their police officers' actions, fully liable under the law. I now move to formally address the violated state laws and federal laws, although I am not a state prosecutor or a federal prosecutor, but I am a citizen with a right to have a fair trial, and I firmly believe the following state law and federal law violations have occurred by the mentioned Police Officers and the San Andreas Police Department, hence, I respectfully ask this Court and the next prosecutorial authority to take the following argument into account for future references.

  • U.S. CODE TITLE VI, CRIMES INVOLVING PERSONS, Section (A) Assault, torture and murder, Subsection (4)

  • ARTICLE II. CRIMES AGAINST A PERSON, SA-PSC § II.15. Attempted murder
The officers discharged lethal force with the intent to kill. There was no lawful justification, I was not posing any detrimental life threatening action upon someone or someone's property. Their action is the very definition of attempted murder, and SAPD's paltry settlement offer confirms their knowledge of this unlawful action. Even Captain James Campbell has admitted to the fact that the involved officers are guilty of attempted murder, which can be proven through a review of Captain James Campbell's bodycam while he was speaking to me at his office.
  • ARTICLE II. CRIMES AGAINST A PERSON, SA-PSC § II.16.1. Assault with a deadly weapon
My body endured an impaction of 25 rounds of 9x19mm Parabellum, which were discharged by Greston Diddy and Reston Diddy as far as I know. The deadly weapon in question is seemingly recognized to be an MP5 model.

San Andreas Police Department officials, namely Captain James Campbell and Chief of Police Kacper Kowalski, attempted to settle the matter quietly and failed to refer the matter to San Andreas Police Department's Internal Affairs Bureau investigators, state prosecutors, or federal prosecutors. This is a clear abuse of power and corruption in broad daylight, intended to protect fellow officers rather than uphold justice.

Your Honor, I respectfully draw attention to a concerning breach of SA-PSC § III.10 Obstruction of justice. The San Andreas Police Department command staff, notably Chief Kacper Kowalski and Captain James Campbell, failed to initiate a full criminal investigation or disciplinary action proportional to the gravity of the criminal offenses. Instead, I was presented with the aforementioned settlement offer of $400,000 USD and verbally informed of a 3 day suspension for the involved officers. I had to repetitively insist on getting the settlement offer written on a paper, perhaps they didn't want to leave any paper trail behind to avoid future consequences, they tend to handle things in a verbal manner. I assert that this settlement was not an act of total accountability, but a tactical maneuver to maliciously suppress a legitimate claim and avoid due legal process and application of justice. Furthermore, these acts indicate a willful objection to the course of justice and may fall within the scope of obstruction of justice as defined by the state law. I urge this Court to take notice of the apparent internal cover up and to compel the department to release the relevant evidence and explain the rationale behind their actions, or lack thereof. The San Andreas Police Department knowingly harbored officers who should have been investigated and prosecuted for their felonious crimes.
  • U.S. CODE TITLE IX, CIVIL RIGHTS, Section (A) Conspiracy against civil rights, Subsection (1), in conjunction with U.S. Constitution, ARTICLE I: THE BILL OF RIGHTS, SECTION II
There is compelling evidence in San Andreas Police Department's database for radio transmission logs or recorded audios that the officers involved, Greston Diddy, Reston Diddy, and Hermann Emerson, acted in coordination and executed an unlawful order to use deadly force against me without legal justification. Additionally, compounded by the San Andreas Police Department's failure to initiate a proper criminal investigation and prosecution, and their subsequent offer of a financial settlement with minimal disciplinary consequences, presents a form of a deliberate conspiracy to demean and turn a blind eye to the second section of the first article: "THE BILL OF RIGHTS" of the U.S. Constitution.

The use of excessive and unjustified deadly force by police officers, acting as a law enforcer and wearing uniform of the San Andreas Police Department, directly resulted in the willful endangerment of my life, despite not presenting any imminent threat, nor having committed any criminal act warranting such force, I was shot 25 times in the head area, and no reason or warning was provided prior to opening fire, this is an overkill with malevolent intent. I posed no threat to someone's life or someone's property, and yet I was assaulted with deadly force by the so called law enforcers. The Constitution explicitly prohibits the use of arms in such circumstances. Their conduct, as law enforcers, not only breached the San Andreas Police Department's internal protocols and the laws but also violated the most fundamental civil rights guaranteed by the U.S. Constitution.
  • ARTICLE VIII. MISCELLANEOUS LAWS, SA-PSC § VIII.2. Soliciting
Your Honor, according to Greston Diddy's statement at the Los Santos Police Department station regarding the reason for opening fire at me, Cadet Hermann Emerson has given the order to shoot at the "Rancher", which is the vehicle I was driving at that moment. Thus, Cadet Hermann Emerson must be held liable for the same charges as Greston Diddy and Reston Diddy for soliciting them to "Shoot at the Rancher," which almost rendered me a painful death. This is easily proven if the Court obtains the police radio transmission logs or recorded audios, or even Greston Diddy's bodycam footage, where he clearly mentions that he executed Hermann Emerson's order, not a fair move to shift blame on others.


II. EVIDENCE

    Surgeon: Dr. Natasha Myers

    Pre-operative Diagnosis:
    Primary: Multiple Gunshot Wounds (GSWs) to the upper torso — including the left back, flank, and scapular regions (25 total entry wounds).
    Secondary: Suspected intercostal artery injury and pulmonary contusion with signs of internal hemorrhage and respiratory compromise.

    Post-operative Diagnosis:
    Primary: Multiple Gunshot Wounds to upper torso (left back, flank, scapula) confirmed.
    Secondary: Right intercostal artery injury (actively bleeding) successfully ligated; pulmonary contusion managed conservatively.

    Clinical Findings:
    Upon arrival, the patient presented with multiple penetrating wounds to the left upper back, scapular region, and lateral thoracic wall, consistent with high-velocity gunshot injuries. There was active external bleeding and signs of hypovolemic shock (tachycardia, hypotension, altered mental status).
    Breath sounds were decreased on the left side. Palpation indicated subcutaneous emphysema and tenderness over the ribs and scapula.

    Initial chest X-ray and CT confirmed:
    =Multiple metallic foreign bodies (bullet fragments) in the thoracic cavity
    =Left-sided hemothorax
    =Pulmonary contusion in the lower lobe
    =Disruption of intercostal vasculature, consistent with active internal bleeding

    No spinal injury or major vascular trauma was identified. Neurological status remained intact.
    Operation Performed:
    Exploratory Thoracotomy with Removal of Multiple Projectiles, Hemostasis of Intercostal Artery, and Management of Pulmonary Contusion

    Procedure:
    After informed consent was obtained and general anesthesia was administered, the patient was placed in a left lateral decubitus position. A left-sided exploratory thoracotomy was initiated through the 5th intercostal space. Upon entry into the thoracic cavity, active hemorrhage from a lacerated intercostal artery was identified. Immediate hemostasis was achieved using ligation and electrocautery.

    A systematic exploration of the thoracic cavity and surrounding musculature revealed twenty-five (25) retained bullet fragments localized in the left upper back, scapular region, and lateral thoracic wall. These were carefully dissected and removed individually. Surrounding tissues were assessed for necrosis or vascular compromise.

    Inspection of the pulmonary parenchyma indicated a moderate pulmonary contusion on the left lower lobe, presenting as a bruised, edematous, and congested area without active bleeding or major laceration. Contused lung segments were managed conservatively; no lobectomy was required.

    The thoracic cavity was irrigated with warm saline, and two chest tubes were placed for drainage and post-operative lung re-expansion. The incision was closed in anatomical layers with absorbable sutures.

    The removed projectiles were carefully catalogued and secured in a sealed evidence bag, then handed over to Mr. Otis Spuckler. Container ID #0002, chain of custody: Dr. Natasha Myers

III. DEMANDS

Your Honor, the officers who nearly ended my life walk free, the police department harbors murderous officers, but my body carries the trauma, my life was nearly taken, and I'm unable to physically or mentally perform the duties required by my profession, this unfortunate incident has led to a complete loss of income and professional stability, causing financial and emotional hardship, and my only recompense was hush money. This is not justice, this is a systemic failure, and I ask this Court to bring justice upon it. Therefore, I respectfully demand the following:
  • 1. The Defendants (Greston Diddy and Reston Diddy) to be dishonorably discharged from the San Andreas Police Department.
  • 2. A formal request for the Court to issue arrest warrants and task the Internal Affairs Bureau of the San Andreas Police Department or the Federal Bureau of Investigation with its execution to promptly apprehend and prosecute the Defendants (Greston Diddy and Reston Diddy) for imprisonment in the state penitentiary in accordance with the state law and federal laws.
  • 3. A subpoena to be issued to compel the release of police vehicle (Infernus) and (Police Rancher) dashcam footage and bodycam footage of Greston Diddy, Reston Diddy, Hermann Emerson, James Campbell, Kacper Kowalski, and the police radio tranmission in the format of MP3 audio or encrypted transcript from the San Andreas Police Department database. The mentioned dates and times are required to further prove my claims (Time: From 00:11 CET to 01:04 CET, Date: 27/07/2025) | (Time: From 23:03 CET to 23:50 CET, Date: 27/07/2025).

  • 4. A federal investigation to be launched into this matter, with top priority and urgency. The investigation should focus not only on the initial incident, which is attempted murder, but also on the systemic failure to address it, and whether departmental corruption is present within the San Andreas Police Department's leadership.
  • 5. Upon the adjudication of this case, the San Andreas Police Department must issue a formal public apology to Mr. Otis Spuckler. This apology must be published across the department's official social media platforms and accompanied by a written letter of apology bearing the official San Andreas Police Department seal and the signature of Chief of Police Kacper Kowalski, acknowledging the wrongdoing, preserving public accountability, and restoring the dignity of the victim.
  • 6. A total compensation of surgical expenses, mental and physical therapeutic expenses, medication and prognosis expenses, financial loss due to physical and mental inability to perform my duties in my profession, and $2,000,000 USD for the remedy of being a victim of heinous police criminality and brutality.
  • 7. A formal Court recommendation for a full reevaluation of Chief of Police Kacper Kowalski and Captain James Campbell's eligibility to continue serving in command positions within the San Andreas Police Department.
  • 8. Referral to the state prosecutors and federal prosecutors for potential criminal prosecution under federal and state law as addressed in the I. OPENING STATEMENT.
  • 9. Request the Court to summon and form an ad hoc committee from the U.S. House of Representatives to review the conduct of San Andreas Police Department personnel involved in this matter, especially the command chain.
  • 10. Request for immediate suspension of the following officers (Greston Diddy, Reston Diddy, Hermann Emerson) while this civil action is pending review and adjudication.
  • 11. Request for immediate suspension of Chief of Police Kacper Kowalski from the Staff Office and Captain James Campbell from the Command Office while this civil action is pending review and adjudication, if deemed necessary and justified by the Court.

RECUSAL REQUEST



I, Otis Spuckler, hereby file this motion to request the recusal of any official affiliated with the San Andreas Police Department from presiding over this matter, "CV-134", due to a clear and direct conflict of interest and repetitive errors present in the Hon. Trial District Judge Steve Anderson's response. No individual with a direct or professional affiliation to a party in a lawsuit should participate in the handling of the said case, with the aim of maintaining the impartiality and fairness of the Court. The involvement of Hon. Trial District Judge Steve Anderson must be reconsidered and recused, the rationale of such motion will be thoroughly explained below.

Before proceeding to address the mentioned errors, I must express my deep disappointment regarding the repeated procedural, grammatical, and ethical errors present in the response issued by the current presiding judge. The mischaracterization of my role as a "Civil Prosecutor" in the official civil action recognition. In a civil case like this, I should be properly referred to as a "Plaintiff" or perhaps a "Claimant", not as a "Prosecutor", which is a term reserved for criminal cases brought by the state or federal prosecutorial authorities. Furthermore, I refer you to the assigned case docket "CV-134", which appears to be different from the proper sequential docket tracking order, which is a four digit format "CV-0000", and was omitted in the abstract of the Court's response, despite referring to it in the first paragraph of the civil action recognition. Moreover, the lack of clarity in the recognition of this civil action is blatantly obvious, while the San Andreas Police Department is explicitly named in both the title and the list of involved parties, it appears that Hon. Trial District Judge Steve Anderson omitted the San Andreas Police Department as a formal Defendant in his acknowledgment. Alarmingly, there appears to be a grammatical and procedural error in the Court's identification of the named parties, wherein the Hon. Trial District Judge Steve Anderson refers to "Greston Diddy, Reston Diddy, and Hermann Emerson" collectively as "the Defendant" singular, given that these are three distinct individuals and the San Andreas Police Department as an entity, the correct terminology should be "the Defendants", as this misstatement reflects a lapse in legal precision. Additionally, I would like to highlight two clear typographical errors in the Hon. Trial District Judge Steve Anderson's response in this case. First, the name "Mr.Spuckler" is written without a space following the period behind the salutation, which is a basic formatting mistake. Second, the word "deemed" is misspelled as "demeed". Not only was there a failure to properly identify multiple Defendants, untidiness in docket tracking, mischaracterization of the Plaintiff, direct conflict of interest, and typographical and grammatical errors, but the Hon. Trial District Judge Steve Anderson also inaccurately referred to himself simply as "Honorable District Judge" in the signatory part of his response, omitting the appropriate judicial title of his which is "Hon. Trial District Judge".

Such cumulative errors indicate a disregard for ethical and legal standards and show a broader issue of inattentiveness unbecoming of a presiding judge. The Hon. Trial District Judge Steve Anderson has demonstrated a remarkable lack of diligence in his judicial responsibilities, thereby further reinforcing the necessity of his recusal, not solely on the grounds of direct conflict of interest, which is sufficient for recusal, but also due to lack of attentiveness required of the judge in such important and highly detailed civil action.

Your honor,

The San Andreas Police Department will represent itself.

The Department also wishes to file for a motion to dismiss the case.

The Plaintiff has submitted a complaint to the Department on Sunday, July 20, 2025 at 12:23 am. The Department has swiftly punished all of the officers involved in this incident - Greston Diddy, Reston Diddy and Hermann Emerson. The punishments consist of a suspension for all of the individuals, with Officer Greston Diddy being demoted from the rank of Officer for several unrelated violations.

In the meantime, The Chief of Police has been informed by the FBI that the FBI has initiated its own proceedings against these officers, and the officers were quickly thereafter apprehended by the FBI and placed in holding cells, thus making the Department unable to further act upon the individuals as they have been placed in federal custody.

The Department now awaits for the FBI to complete its proceedings before regaining access to the officers in question, and issuing them a dishonorable discharge from the department pursuant to the findings by the FBI.

The Department has offered $400,000 to the Plaintiff for compensation, and the defendant has refused the monetary compensation. It is without prior precedent that a party in a civil requests a settlement that does not involve monetary compensation, but a discharge.

Your Honor,

In response to the Court's request to provide a list of witnesses for this incident, I must note that I struggle to have any recollection of the presence of anybody else other than Greston Diddy, Reston Diddy, and Hermann Emerson being present at the moment of attempting to murder me with deadly force. As such, I am currently unable to provide any additional witnesses. However, once the relevant footage of the incident is made available, it may help identify potential witnesses who were present at the time and location.

Moreover, I submit this objection to the San Andreas Police Department's unsolicited commentary filed in response to the Court's simple inquiry regarding representation. Instead of responding solely to the judicial question, the Department used the opportunity to deliver an unsanctioned opening statement and a motion for case dismissal, these actions overstep the Court's procedural bounds and attempt to prejudice the ongoing proceedings. This is an apparent "Contempt of the Court", I ask the Court to act upon it.

The San Andreas Police Department's filing of an unpermitted argument and a motion of dismissal goes beyond the Court's inquiry and resembles an unsanctioned attempt to dictate the narrative before proper pleadings and evidentiary hearings have taken place. This undermines the fair and common process required in a civil action. Thus, I urge the Court to formally strike this portion of their filing or disregard any arguments made outside the scope of the Court's question.

Lastly, I respectfully urge the Court to reissue a corrected recognition of the lawsuit, as the prior presiding judge failed to accurately identify the Defendants and omitted key procedural details, as outlined in my Recusal Request.

Some of ur demands have been taken care of, such the Federals taking care of us, getting us suspended without hesitating, making me pay a fine of 2,500,000$ We're out from SAPD for 3 months and cannot join any law enforcement group such SAHP SASD. Your other demands are really greedy + my words were clear as you can see what i said to Greston and Reston and the Officers that were part of that Pursuit at Red County.

Now if the order gone by my word which was to shoot the Rancher and not kill the DRIVER of the RANCHER, then you would still have the right to file a lawsuit against us and SAPD, but with lower punishments against us the officers, and lower monetary fines. So why would i be taken by the FBI and get the same punishment as Reston and Greston when they were the ones that did nearly take your life ? If they correctly listened to my words they wouldn't try to kill you for standing next to an criminal thinking that you're about to aid him.

Your recusal request was accepted too. So why take it so far like that Mr. Spuckler ?

I. FINDINGS
  • The Court finds that the San Andreas Police Department's filing of an unauthorized Motion to Dismiss and argumentative statements, after the Court had already recognized the sufficiency of the Plaintiff's complaint, constitutes a direct disregard of judicial authority and undermines the integrity of these proceedings. This conduct amounts to contempt of this Court.
  • While the Court considers the gravity of this action, it will, at this time, exercise restraint and issue a remedial sanction rather than a punitive fine. The SAPD is hereby ORDERED TO SHOW CAUSE in writing within 48 hours why further sanctions should not be imposed for this conduct.

II. ORDERS
  • The Court recognizes the Plaintiff's need for evidence exclusively within the possession, custody, and control of the Defendant SAPD to fairly prosecute this case and for the Court to ascertain the truth.
  • The Court GRANTS the Plaintiff's request for a subpoena.
  • The SAPD is COMMANDED to produce to the Court and to the Plaintiff, no later than 48 hours from the date of service of this subpoena, complete and unredacted copies of all digital and physical evidence pertaining to the incident involving Plaintiff Otis Spuckler on the relevant date, including but not limited to:

    a. All dash-mounted camera footage from any SAPD vehicles present.
    b. All body-worn camera footage from Officers Greston Diddy, Reston Diddy, and Hermann Emerson.
    c. The complete incident report, complaint file, and any subsequent internal investigation file.
    d. All radio transmission logs, transcripts, and original audio recordings.
    e. Any photographs, videos, or other documentary evidence.

  • The Defendant, San Andreas Police Department have violated SA-PSC § III.7 (Contempt of Court) by disregarding the Court’s directives and showing disrespect toward these proceedings.
  • The Defendant, San Andreas Police Department have violated SA-PSC § III.9 (Failure to Abide by a Court Order) by refusing to comply with the Court’s prior order to file a responsive pleading and produce subpoenaed evidence.
  • The Defendant, San Andreas Police Department silence in response to the Court’s Order to Show Cause and their failure to produce the subpoenaed evidence are deemed intentional and indicative of bad faith.


II. ORDERS

  • The Defendant, San Andreas Police Department is FINED $200,000 for its contemptuous conduct and failure to comply with the Court’s orders.
    • The Defendant, San Andreas Police Department is ordered to IMMEDIATELY PRODUCE all subpoenaed evidence to the Court and the Plaintiff within 48 hours. Failure to do so will result in additional sanctions, including increased fines and potential criminal contempt proceedings.
