Since the Defendant is appearing uninterested in cross examining the first witness, we'll take the second witness's and call him out to the stand, have the Plantiff's question ready to proceed, and may begin their questioning to the second witness.

The Defendant has 24 hours from the second witness's answers to cross examine or move to the closing statement. Otherwise. We'll move directly to the ruling.

State of San Andreas v. Gustavo Flaco

Your honour,

The prosecution would like to call Senior Detective Martin Winchester to the stand. Detective, on the 1st of January, 2025 – specifically the day of search warrant execution. Let's quote what Lieutenant Kacper Kowalski had said:

Kacper Kowalski wrote: Tue Jan 07, 2025 6:09 pm

*Kacper enters the courtroom as he sits on his chair in his black tux, raising his right hand, while he sets his left on the bible*

I, Kacper Kowalski, do solemnly, sincerely and truly declare and affirm that the testimony I shall give shall be the truth the whole truth and nothing but the truth. To the best of my knowledge, I acknowledge that lying in a legal proceeding is perjury and a federal crime.

As the prosecution said, we had a warrant to search the premises at GPS 840, upon arrival, we asked the defendant whether or not he owned the property. The defendant *points at Gustavo* acknowledged that he owned the property, and once he was shown the search warrant, he ran. Two of our detectives went to apprehend Gustavo, while myself and Mark went to search the premises, and that's when we discovered the immense amount of illegal contraband.

  • Do you agree on everything he has stated?
  • As Lieutenant Kacper Kowalski had testified, were you a part of that "two detectives" who went to apprehend Mr. Gustavo Flaco?
  • If yes, can you tell the court who was with you when you apprehended the defendant? How did you manage to apprehend him?

To remind everyone once again in this court, the witnesses that the prosecution will call is under the declaration of oath. Senior Detective Martin Winchester, before you begin – kindly tell everyone in this court about the declaration of oath:

"I, [YOUR NAME], do solemnly, sincerely and truly declare and affirm that the testimony I shall give shall be the truth the whole truth and nothing but the truth. To the best of my knowledge, I acknowledge that lying in a legal proceeding is perjury and a federal crime."

WITNESS TESTIMONY

* Martin Winchester treads towards the stand upon being summoned as a witness. His presence alone commanded attention, he was a man of conviction and measured words, his every move methodical.

* The bailiff holds out the Bible, and Martin glances into his eyes before placing his hand on the book with a steady grip. His voice is deep and unfaltering as he breaks the silence:

"I, Martin Winchester, do solemnly, sincerely and truly declare and affirm that the testimony I shall give shall be the truth the whole truth and nothing but the truth. To the best of my knowledge, I acknowledge that lying in a legal proceeding is perjury and a federal crime."

* His gaze sweeps around the courtroom as he prepares to deliver his testimony with the same unyielding purpose that defined him.

  • Do you agree on everything he has stated?
Martin Winchester: I do agree with the testimony provided by Mr. Kacper Kowalski in this matter.
Mark D. Henderson wrote: Mon Jan 13, 2025 5:15 pm
  • As Lieutenant Kacper Kowalski had testified, were you a part of that "two detectives" who went to apprehend Mr. Gustavo Flaco?
Martin Winchester: Indeed. I, Senior Detective Martin Winchester was present during the apprehension of Mr. Gustavo Flaco.
Mark D. Henderson wrote: Mon Jan 13, 2025 5:15 pm
  • If yes, can you tell the court who was with you when you apprehended the defendant? How did you manage to apprehend him?
Martin Winchester: Detective Mircea Niko and I, Senior Detective Martin Winchester, had to deploy a Taser to successfully apprehend Mr. Gustavo Flaco, as he attempted to flee the scene following the presentation of the search warrant.
I'm done with my testimony as a witness.

It appears that Mr. Gustavo Flaco is unwilling to respond to this Court, despite several warnings, and thus for his unwillingness we'll proceed to ruling this case. Let it be recognised that the Court is adjourning this case ruling to 19th of January, 2025.

State of San Andreas
v.
Gustavo Flaco
CASE # CV-0122
HONORABLE JUDGE PRESIDING:
Kira Hernandez

*Hon. Judge Kira Hernandez enters the Court room, takes a seat as she puts on her glasses and grabs the case file in front of her.*

*silence in the Court room as the Judge have looked up at the Plaintiff*

The First Judicial District Court recognised this criminal case as submitted by the Prosecutor Detective Mark Henderson on behalf of San Andreas Police Department on Saturday January 4th, 2025 at 9:39 AM. Let it be recognised that the court has assigned this case ID # CV-0122.

*Hon. Judge Kira Hernandez says*: Where is the Defendant?

*Hon. Judge Kira Hernandez looks around, a disappointment look at her*

*Hon. Judge Kira Hernandez says*
: I'll be ruling as adjourned in that case.

I. FINDINGS
The evidence provided in the initial documentation provided by the state prosecution against Mr. Gustavo Flaco, henceforth the Defendant, has been reviewed and has found it sufficient enough to proceed with the charges against the Defendant.

Mr. Gustavo Flaco hasn't plead guilty.

Mr. Gustavo Flaco has been found violating the following laws;

ARTICLE VI. CONTROL OF DANGEROUS SUBSTANCES AND ITEMS
  • SA-PSC § VI.1. Possession of an illegal substance.
  • SA-PSC § VI.2. Possession of weapons and explosives.
  • SA-PSC § VI.3. Miscellaneous items.
ARTICLE III. CRIMES AGAINST THE UNITED STATES OR A STATE
  • SA-PSC § II.13. Resisting arrest.
Any action that an individual performs to oppose resistance to a law enforcement official that is lawfully detaining him.
The San Andreas Police Department issued search warrant following an undercover operation, investigating the arms dealing by the Defendant Mr. Gustavo Flaco. The Defendant had been found on the scene of the same operation on Exhibit I, executed by the Detectives of the Police Department of San Andreas. Following his arrest, the search warrant from Exhibit II concluded that the Defendant had been in possession of illegal military grade weaponry as well as other substances and explosive devices as outlined by the Plaintiff's evidence; Exhibit III.

The Court also acknowledged the testimony of both Detective Kacper Kowalski & Detective Martin Lawrence, being part of the operation. Be it that the Defendant, Mr. Flaco had fled the scene after being confronted by the Detectives about the warrant.

The Court provided Mr. Gustavo Flaco the opportunity to take a settlement offer provided by the Plaintiff as well as a lawyer and enough time to reconsider his testimony and motion. The Court finds that Mr. Flaco is unwilling to attend this hearing and we will proceed with the ruling regardless.

II. RULING
The court finds Mr. Gustavo Flaco guilty of the aforementioned crimes, therefore he is sentenced to:
  • 15 Years in Prison.
  • Seizure of 40% of the Defendant's net-worth totaling $1,863,135.
*Bangs her Gavel*

*Hon. Judge Kira Hernandez takes off her glasses and nods at the present people at the Courtroom*
