State of San Andreas v. Gustavo Flaco



I. OPENING STATEMENT

The San Andreas Police Department has assigned Mr. Mark Henderson for this prosecution against Mr. Gustavo Flaco for the violation of several state laws.

On 30th of December, 2024 - approximately 20:00 CET, an undercover detective purchased an illegal weapon, specifically two AK47 cases, from Mr. Gustavo Flaco. The deal took place near his house, which is located in Idlewood Motel, Los Santos.

On 1st of January, 2025, a search warrant was issued into the defendant's properties upon the approval of Lieutenant Kacper Kowalski. The Detective Bureau carried out the search warrant execution, prior to their arrival at Mr. Gustavo Flaco's properties – the defendant was present nearby in his property. The defendant was asked if the address, #840 Idlewood, Los Santos, belongs to him – in which he confirmed. The detectives presented the search warrant onto the defendant and was asked to open the door. As soon as the defendant have read the search warrant, the defendant began to ran away in which he was later on apprehended by the detectives. Prior to the defendant's apprehension, the detectives has executed the search warrant in which they had discovered multiple kinds of contraband:

○ C4 Explosives, x3

V. SETTLEMENT OFFER
The San Andreas Police Department offers a reduced sentence to expedite the hearing for all parties involved. The revised terms are:

○ The defendant to serve 10 years in a state penitentiary.

The First Judicial District Court recognises this Criminal Lawsuit as submitted by the Prosecutor Detective Mark Henderson on behalf of the San Andreas Police Department, henceforth the Plaintiff. The evidence provided in the initial documentation provided by the state prosecution against Mr. Gustavo Flaco, henceforth the Defendant, is deemed as sufficient and removes possibility for summary dismissal. Let it be recognised that the court has assigned this case ID # CV-0122.

To the Defendant:
You have forty-eight (48) hours to confirm whether you will be represented by a legal counsel or intend to defend yourself in this case. If you have hired legal counsel, please have them reply to this court communique with their details. Failure to confirm these details within the 48 hour window will result in this court issuing a summons for your appearance. Failure to appear before this court does not invalidate this case and we will proceed without you if we need to.

The respective individuals, and myself had witnessed the defendant attempting to flee after the search warrant was promptly presented to him. Additionally, these witnesses were present during the search warrant execution.

Your Honour,

I, Gustavo Flaco, would like to Paint the full picture about what happened and was happening behind the detectives eyes.

I, Gustavo Flaco, is known in the City of Los Santos for Selling Properties all around the city,I always buy houses,apartments and mansions then resell them, one of the houses that i got my hands on is the house that the Illegal stuff was found inside , My dear friend and business partner Mr.Olmo Olizi found that house for sale, He Couldn't buy that house in that particular moment because he had 3 houses already, So i bought that house, and i haven't touched it since, i didn't know about the stuff that was inside it storage because i treated it as any other house i sell, i bought it , checked it alarm level and safe level, priced it and put it for sale, so i had NO idea about the stuff in that storage.

That house happened to be near my friend's Olmo Olizi house, which is a place me and other friends Chill and relax in, The day i had a deal with the named "Nate Esparza" who turned out to be a Detective, i managed to get my hands on 2 AK47 CASES which i found in a gift infront of my Other house NR.539 , when i got my hands on those cases "Nate Esparza" Contacted me on the walkie talkie telling me if i had AK CASES for sale I happened to be in my Friends OLMO OLIZI House aka "My chilling spot" and we had a deal there , but doing the deal for 2 AK CASES in that area had no relation to the house i owned in that area, as i said earlier that house was for and only for sale at that point.

To put it in conclusion, I had 0 idea of what was in the storage of that house.

SA-PSC § VIII.7. Ignorance of the law
Any individual who claims ignorance of the law to avoid the consequences of their actions, shall not have said claims deemed as a reasonable excuse.
Therefore it will not proceed with any motion of dismissal.
