[# CV-147] Newsweek San Andreas v. StateLine Network

Post by Otis Spuckler »

THE LEGAL LOOP LLP

Copyright Infringement Complaint

Newsweek San Andreas

v.

StateLine Network

I. OPENING STATEMENT

I, Otis Spuckler, Managing Partner of The Legal Loop, LLP, licensed attorney within the State of San Andreas, hereby appear before this Court and, on behalf of my Client, Newsweek San Andreas, abbreviated as (NSA), and its Board Member and Copyright Holder, Mr. Mark Garrick, collectively hereinafter the Plaintiff, respectfully file this Complaint for Copyright Infringement against Stateline Network, abbreviated as (SLN), hereinafter the Defendant.

This action arises out of the Defendant's audacious and willful use of the copyrighted and protected vehicle color scheme, specifically the Dark Blue and Black color scheme of Plaintiff's vehicle (model: Newsvans). The aforementioned color scheme has been approved and protected by prior judgment of this Court, to protect commercial use of this vehicle color in the Plaintiff's area of business, which is journalism and news broadcasting, similar to the Defendant's field of commerce, while the Defendant has nonetheless engaged in the audacious act of copying the vehicle color scheme and even attempting to claim ownership of it through an improperly formatted filing, [Click here for review].

On the 13th of July, 2025, the First Judicial District Court of San Andreas approved and granted copyright protections to the Plaintiff, covering, inter alia:
  • Quotation: Distinctive color scheme of "Dark Blue" and "Black" on the (Newsvan) vehicle model, when used in a manner that would reasonably cause confusion with Newsweek San Andreas.
*Reference: [Click here for review]

The presented approval explicitly mentions that "judgment of similarity shall be determined by a District Judge of the First Judicial District Court of San Andreas" in cases of potential violation. Plaintiff has since continuously used the Dark Blue and Black color scheme on its Newsvans in the course of their commercial use. The Defendant has painted an identical color scheme on its own fleet of Newsvans, consisting of Dark Blue and Black combinations, in a manner likely to cause confusion. It is worthy of the Court's attention to take note that the approved Copyright Patent of the Newsweek San Andreas is still effective to this date, and until the 13th of July, 2026. Additionally, the Plaintiff, through its legal representative, made attempts on 15th and 16th of August, 2025, to contact Stateline Network regarding this dispute in an effort to reach a settlement, however, these attempts were ignored by the Defendant both on the phone call and email correspondence, while there was limited communication and an incomplete exchange of documents between the legal representatives of Newsweek San Andreas and Stateline Network, no response was ever provided, thus, the Plaintiff is left with no choice but to pursue litigatory steps.

Flavius Belisarius wrote: Sat Aug 16, 2025 1:32 pm To Whom It May Concern,
Regarding your recent allegation about the use of a black-and-blue color scheme,
I am reaching out to you in my role as StateLine News' legal representative. Upon close examination, it is clear that:

Before the creation of our current branding, your organization was ((inactive)) and formally shut down, so it is no longer in operation and currently not in any kind of official presence.

There is no chance of confusion in the marketplace because StateLine News uses a different shade and arrangement of colors than those traditionally associated with your agency.

Without a distinctive and currently registered trademark FOR THIS PARTICULAR SHADE AND LOOK, which your company does not currently possess, color combinations by themselves are not protected unless presented with the correct evidence that matches our current trademark usage.

By these facts, there is no legal position to your claim, and continuing in regard to this matter would be time-consuming and will not bring any benefit for either of these sides.

We nicely ask that you withdraw your complaint immediately, please. And would like to inform you that we are fully prepared to defend our cause here.

We look forward to resolving this matter without the need for escalation.
Sincerely,
Flavius Belisarius
Representing the StateLine News.

Mr. Belisarius,

Do you possess an attorney's license to practice law in the state of San Andreas? If yes, what is your title? Please provide documentation.

Respectfully,
Dated: 16/08/2025
Otis Spuckler
Legal Representative of Newsweek San Andreas
*** For clarification regarding this correspondence: NSA's copyright and trademark protections, covering its distinctive color scheme, were approved by the Court on the 13th of July, 2025, these protections remain in full legal effect until the 13th of July, 2026. The similarities between SLN's vans and those of NSA create a clear likelihood of public confusion, which is precisely the type of harm that copyright and trademark protections are intended to prevent. SLN's claim that the NSA lacks protection is incorrect, the Court's approval is a matter of record, and NSA holds priority rights in this matter.

III. PRAYER FOR RELIEF

The Plaintiff seeks judicial recognition of this infringement, the immediate cessation of Defendant's illegitimate practices, withdrawal of its pending Copyright Patent application, and full compensatory damages together with attorney's fees and all costs of this litigation. Wherefore, the Plaintiff respectfully requests that this Court enforce judgment against the Defendant as follows:
  • A declaration that Defendant's use of the Dark Blue and Black color scheme indicates Copyright Infringement.
  • An order enjoining Defendant from continued use of the Dark Blue and Black scheme on any of its vehicles or brandings.
  • A Court order for denial of the concurrent Copyright Patent filed by the Defendant for the StateLine Network.
  • An award of monetary remedy to Plaintiff in an amount of $500,000 United States Dollars.
  • An award of attorney's fees and costs incurred in bringing this action, a total of $1,462,697.37 United States Dollars.
  • A summary judgment on similarity to be conducted by the Court.
  • Such other and further relief as this Court deems just and proper.

IV. SIGNATORY

Respectfully submitted,

CASE # CV-147

Newsweek San Andreas (Plaintiff)
v.
StateLine Network (Defendant)

DEFENDANT’S RESPONSE TO COMPLAINT

I, Luna Carrington, acting as the authorized representative of StateLine Network (SLN), respectfully submit this response to the Complaint filed by Newsweek San Andreas (NSA) through their legal counsel, The Legal Loop LLP.

I. GENERAL DENIAL

The Defendant, StateLine Network, denies all allegations of copyright infringement as asserted by the Plaintiff, except those expressly admitted herein.

II. SPECIFIC RESPONSES

On Color Scheme Distinction:

SLN utilizes a light blue primary tone, with only minimal dark accenting, whereas the Plaintiff’s approved copyright patent pertains to a predominantly dark blue and black combination.
The two appearances are visibly distinct, with no likelihood of reasonable confusion by the public or consumers.
On Plaintiff’s Inconsistent Evidence:

The Plaintiff’s newly submitted “evidence” demonstrates a different shade of blue and an alternate camera angle/vehicle position from the original official patent screens submitted during their registration on July 13, 2025.

This inconsistency calls into question the accuracy, authenticity, and stability of the Plaintiff’s claimed color protection. If multiple shades and positions are being presented, it undermines the “distinctiveness” required for copyright enforcement.

On Prior Activity of Plaintiff:
At the time SLN finalized and adopted its branding, the Plaintiff’s operations were inactive and not in commercial use, diminishing any claim of ongoing distinctiveness in the market.

- As you can see above our News Vans color shade as well, loophole doesn't match their color.
- Their HQ where they sent their patent contract reference viewtopic.php?t=18595 there are no more News Vans there.

On Absence of Confusion:

SLN operates with branding and logos that are clearly distinguishable from NSA.
The public associates SLN with its unique identifiers (logo, HQ at Conference Center #1811, custom exterior and interior, etc..), which ensures there is no material risk of misidentification.

III. DEFENSES

Fair Use / Independent Creation:
SLN developed its branding independently, with a different shade, layout, and theme, and did not rely upon NSA’s alleged design.

Lack of Exclusivity:

Simple color combinations (such as dark and blue tones) are not inherently protectable without precise and narrowly defined trademarks. NSA’s current claim seeks overly broad enforcement.
Failure of Plaintiff to Maintain Consistency:
Plaintiff’s own submissions demonstrate a lack of fixed, consistent branding within their claimed patent, further weakening enforceability.

IV. PRAYER FOR RELIEF

The Defendant respectfully requests that this Court:
Deny Plaintiff’s Complaint in its entirety.
Recognize that SLN’s color scheme is distinct and non-infringing.
Reject Plaintiff’s claims for damages and injunctive relief.
Grant such other relief as the Court deems just and proper.

(( Legal Representation ))
Should this matter escalate, our attorney Gregory Walker will represent StateLine Network in pursuing legal action.

Respectfully submitted,
Luna Carrington
On behalf of StateLine Network (Defendant)
Diana Graves, to serve and protect.
