I. OPENING STATEMENT

Your Honor,

The Bureau formally brings charges against the defendant, Cadet Hermann Emerson, for his direct involvement in an incident that took place on July 27th, 2025, at approximately 00:11 CET in Red County, specifically in the vicinity east of Hilltop Farm.

On the specified date and time, a civilian, Mr. Otis Spuckler, was operating his vehicle, a yellow Rancher, near the scene of an unrelated law enforcement operation. While Mr. Spuckler was within visual proximity of this active scene, he was instructed to leave the area by the defendant, Cadet Emerson.

However, as Mr. Spuckler complied and began exiting the area, Cadet Emerson issued an instruction over the police radio to open fire on the "yellow Rancher", which was at that time posing no immediate threat to any officer or the ongoing operation. Acting on this directive, Cadet Emerson, along with Cadet Reston Diddy and Cadet Greston Diddy, discharged their firearms at the civilian vehicle, striking Mr. Spuckler multiple times.

This use of force was unlawful, unprovoked, and presented gross disregard for life of Mr. Spuckler who was unarmed. The decision to engage was not only a violation of protocol and use-of-force policy, but also demonstrated an alarming lack of judgment, training, and command structure discipline. It is particularly concerning that a Cadet, who is by definition still under training, was able to issue such a directive, and worse, that it was followed without question by others present on the scene.

As a result of this reckless action, Mr. Otis Spuckler sustained multiple gunshot wounds, requiring urgent medical attention and ongoing treatment. His life was endangered without cause, and the trauma inflicted upon him is both physical and psychological.

II. CHARGES

[1x] U.S. CODE TITLE V, (2) Any person in a position of power, whether a law enforcement official, emergency service official, government official or a judicial official, who maliciously uses power shall be removed from the position and imprisoned for no less than 1 year and no more than 20 years;
1x] U.S. CODE TITLE VI, (4) Any person which unlawfully kills or attempts to unlawfully kill another person, unless through self defense which occurred on the premises of the killer's home and is provable through investigative means, shall be imprisoned for no less than 10 and no more than a life sentence;

The First Judicial District Court recognises this criminal case as submitted by the Federal Prosecutor FBI Director Lucas Reed on behalf of United States of America on Friday, August 01, 2025, 21:23 CET. Let it be recognised that the court has assigned this case ID # CV-146.

I. FINDINGS

The evidence provided in the initial documentation provided by the state prosecution against Mr. Hermann Emerson, henceforth the Defendant, has been reviewed and has found it sufficient enough to proceed with the charges against the Defendant. Considering that Mr. Hermann Emerson has pleaded guilty in accordance with the settlement offer by the Plaintiff and the evidence proves beyond doubt that the Defendant is guilty.
The Court finds Mr. Hermann Emerson to be in violation of the following federal laws, as outlined by the Plaintiff:

U.S. CODE TITLE V
(A) Bribery, corruption and abuse of power
(2) Any person in a position of power, whether a law enforcement official, emergency service official, government official or a judicial official, who maliciously uses power shall be removed from the position and imprisoned for no less than 1 year and no more than 20 years;
U.S. CODE TITLE VI
(A) Assault, torture and murder
(4) Any person which unlawfully kills or attempts to unlawfully kill another person, unless through self defense which occurred on the premises of the killer's home and is provable through investigative means, shall be imprisoned for no less than 10 and no more than a life sentence

II. RULING

The court finds Mr. Hermann Emerson guilty of the aforementioned crime(s) as per the evidence provided by the Plaintiff, his guilty plea & revised settlement, therefore he is sentenced to:

• 15 years in a state penitentiary. (( 1 hour & 30 minutes ));
• The defendant is to be fined $2,500,0000;
• The Defendant has to be discharged immediately from the San Andreas Police Department;
• The Defendant cannot join any Law Enforcement Agencies for exactly 3 years (3 months);
• The Defendant can pay the amount stated whenever he want within the given time limit directly to the Government Bank ((Group Account)) ID#1. ((Ensure to provide screenshot of the payment in that case to my Discord DMs or Forum PM me the transfer));
• The time stated in the 2nd point starts from 3rd of August 2025 01:00 CET and ends at the 20th August 2025 01:00 CET. Failure to meet the deadline will result in the Court ordering further asset seizures as outlined in the 3rd point.
