State of San Andreas v. Nikolai Esparza



I. OPENING STATEMENT

The San Andreas Police Department has assigned Kacper Kowalski for this prosecution against Nikolai Esparza.

On the 24th of October 2024, Nikolai Esparza was recorded while accessing the storage of La Familia Esparza's headquarters.

One day later the defendant was arrested and the SAPD executed a search warrant on the property where mr. Esparza loaded and stored contraband.

On the same day a search warrant was issued and executed on all the properties owned by La Familia Esparza and the following items were discovered:

The evidence provided in the initial documentation provided by the state prosecution against Mr. Nikolai Esparza, henceforth the Defendant, is deemed as sufficient and removes possibility for summary dismissal.

I. FINDINGS

On the 1st of November 2024, CASE #CV-0114 was filed by Mr. Kacper Kowalski on behalf of State of San Andreas against Mr. Nikolai Esparza. The First Judicial District Court has reviewed the evidence and has found it sufficient enough to proceed with the charges against Mr. Nikolai Esparza. Mr. Nikolai Esparza has failed to respond to the Court thus we will proceed without his presence.

Mr. N. Esparza is accused to be in violation of the following State and Federal laws, as outlined by the Plaintiff and backed up by provided evidence by the Plaintiffs.

As stated in the State and Federal Law:

CRIMES INVOLVING PROPERTY
(E) Controlled items
  • (1) Controlled items are weapons or substances which are controlled or restricted by law
  • (2) Controlled substances are classed as follows:
    • (A) Class A - Cannabis Indica, Xanax;
    • (B) Class B - Methamphetamine, Heroin, Oxycodone, Percocet;
  • (3) Controlled weapons are classed as follows:
    • (A) Heavy Weapons: M4, AK47, Sniper Rifle;
    • (B) Explosive Ordinance: RPG, Grenade, Molotov Cocktail;
  • (4) It is illegal to possess, manufacture or distribute the following items in the United States:
    • (A) Substances specified under USC VII (E) (2) in any quantity;
      • Exception for Cannabis Indica up to 660g;
      • Exception for Xanax up to 3 pills unless prescribed for up to 24 pills by a state certified doctor;
      • Exception for Percocet up to 1 pill unless prescribed for up to 6 pills by a state certified doctor;
    • (B) Weapons specified under USC VII (E) (3) in any quantity;
  • (5) Any person in violation of USC VII (E) (4) shall be imprisoned for no less than 1 year and no more than 20 years, be issued a monetary fine determined by the District Court and have the illegal items seized

SA-PSC § VI.1. Possession of an illegal substance [M]
It is strictly prohibited in the San Andreas State to possess, manufacture or distribute the following narcotics in amounts greater than permitted:
  • Cannabis Indica (not permitted to posses)
  • Heroin (not permitted to posses)
  • Meth (not permitted to posses)
  • Xanax (not permitted to posses)
  • Percocet (not permitted to posses)
  • Oxycodone (not permitted to posses)
SA-PSC § VI.1.2 Property search and seizure
Law enforcement are authorized to issue a search warrant against an individual who is found in possession of narcotics listed under SA-PSC § VI.1. Possession of an illegal substance if the amount is equal or greater than defined under "Search warrant threshold" column.


SA-PSC § VI.2. Possession of weapons and explosives*** [F]
It is strictly prohibited in San Andreas State to possess, manufacture or distribute the following weapons and explosives in amounts greater than permitted:
  • M4 Assault Rifle (not permitted to posses)
  • AK-47 Assault Rifle (not permitted to posses)
  • Sniper Rifle (not permitted to posses)
  • Molotov Cocktails (not permitted to posses)
  • C4 Explosives (not permitted to posses)
SA-PSC § VI.3. Miscellaneous items [F]
It is strictly prohibited to possess, use, and distribute the items listed below with the exceptions of brass, silver, gold jewelry, and gold bars under the criteria in the list.
  • Marked Money (permitted to posses 150)
SA-PSC § VI.4. Unlisted objects created for an unlawful purpose
Any object that is not listed in this list whose purpose of creation was to violate the rights or safety of others, such as burglary tools can be put up to trial to the judiciary branch of the state
II. RULING
The court finds Mr. Nikolai Esparza guilty of the aforementioned crime as per his guilty plea and is sentenced to:
  • 15 years imprisonment in federal prison. ((90 minutes))
  • 35% seizure of the defendant's net worth totaling $7,774,880.
  • The defendant is given a period of seven days to fulfill the fine in the 2nd point, an amount of 10% interest is added for every 24 hours passed after the time limit is over in case the defendant's didn't pay the debts.
  • The defendant can pay the debts whenever he want within the given time limit to private bank account #24 or group bank account #1 ((Proof of transaction can be forwarded to my forum PMs or my Discord cavosavosk))
  • The time stated in the 3rd point starts from 24th of December 2024 15:00 CET and ends at the 31st of December 2024 15:00 CET. Failure to abide by the date will result in seizure of more of the defendant's properties and/or increasing the debts.
