Are you aware of any policy that restricts SAPD officers from holding outside jobs, including private jobs?
Apart from working for the Police, prior to this law, did/do you work anywhere else?
And since there's a confusion regarding the Plaintiff's case, which has been a point break to the Defendant being overly pointed out. The Court would like to announce that it was already acknowledged, that SAPD raised concerns about private sector employment, it was provided once and for all, but their policies do not support such claims. The issue at hand is whether the SA-PSC § XI is constitutional or not, SAPD's case not being perfectly worded is not the argument in this case and it was established. Anymore arguments dragging this case further from its main issue will not be tolerated.

The Court will allow further questions for both parties on the witness about the constitutional validity of the law. The Court will disregard any misleading or contradictory statements and hold either side in contempt of Court if violated.

May the Defendant ask again or rest, disregarding the two question as quoted above. Twenty Four (24) hours each.

Your Honor,
The witness is not capable to provide statement on constitutionality of the law. The state would not question any furthur.

Your honor, the plantiff is responsible for proving how the law is unconstitutional. Its over a month and plantiff has failed to provide any such evidence, yet the case is going onwards. The state will be happy to counter any arguments from plantiff that actually proves the law is unconstitutional.
Your honor, the state would also like to file a motion in the court and also request the court to dismiss the case as it lacks evidence.

Your honour,

This case is about protecting the integrity of law enforcement. The policy isn’t about politics, it’s about ensuring officers serve without divided loyalties or conflicts of interest. Allowing officers to hold government positions creates an undeniable risk, one that oversight can only address after harm is done.

The members of the public that we serve, must trust that law enforcement remains impartial, independent, and accountable. Our policy is a safeguard, not an obstacle. Dismantling it would set a dangerous precedent, weakening the very institutions meant to protect the people.

We ask this court to uphold our policy and protect the integrity of those who serve.

Objection Your Honor, relevance?

The court has already stated and I quote "The issue at hand is whether the SA-PSC § XI is constitutional or not"

SAPD's internal policy is not relevant to the constitutional issue at hand.

I, Marcus Fernandes will be legal counsel representing defendant and will present the closing statement.
Your Honor,

It is important to note that the Plaintiff has not provided any sufficient evidence to back their claim of the law being unconstitutional. The burden of proof lies with the Plaintiff and it is their responsiblity to prove that the law violates constitution. Since there is no relevant evidence presented, the Plaintiff's claim lacks solid foundation.

Article I, Section V of the Constitution allows state to grant additional rights to citizens and prevents dismissal of their basic rights. SA-PSC XI grants additional right to citizens in the form of multiple employment.

Given that the Plaintiff has not met the required burden of proof and has failed to provide any justifiable reasons for their assertions. There is no legal or factual basis and the claims made remain unsupported. Therefore, the defendant respectfully requests to the Court that it lifts the suspension of law in question.
